Terms of Service
These Terms govern your use of the RangeFlux website and desktop application (collectively, the "Service"), operated by 数藤哲平 / Teppei Sudo ("we" or "us"). By using the Service you agree to these Terms. The Service is currently an Alpha release.
1. Definitions
- Service — the RangeFlux website, desktop application, related downloads, and any updates.
- Alpha — the pre-release period during which the Service is provided for evaluation; features and availability may change without notice.
- Device — a single physical or virtual computer on which the desktop application is installed and activated.
- Plan — the entitlement granted to you to use the Service, including the free trial.
- RTA (Real-Time Assistance) — use of the Service or its outputs to inform decisions during live or online poker play.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service you confirm that you meet this requirement.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the desktop application for your personal, non-commercial study, subject to the Device and duration limits of your Plan (where the free trial constitutes your Plan for purposes of these Terms). The license and any associated account are personal to you and may not be sold, transferred, sublicensed, lent, or otherwise made available to third parties.
4. Free trial
The free trial provides full desktop functionality on one Device for 14 days. We may change or end the trial program at any time.
5. Acceptable use
- Do not use the Service for Real-Time Assistance (RTA) during live or online poker play. "During play" includes any time between hands, on breaks during a session or tournament, and while seated at, or in a queue or lobby for, an active table, regardless of whether you are in the current hand. The Service is intended for offline study and post-session review only.
- Do not reverse engineer, decompile, disassemble, resell, sublicense, or redistribute the Service except as permitted by applicable copyright law.
- Do not share, circumvent, or tamper with license keys or activation.
- Do not use the Service unlawfully or to infringe others' rights.
We may suspend access if we reasonably suspect a violation of this section, and we may cooperate with poker operators or other lawful investigations to the extent permitted by applicable law.
6. Anti-social forces
You represent and warrant that neither you nor any of your associated parties belongs to any organized crime group (暴力団), its members, or any other anti-social forces (反社会的勢力). If we determine that this representation is breached, we may suspend or terminate your access without notice and without liability for any resulting harm.
7. No warranty
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy of outputs, or uninterrupted availability. Solver outputs (including strategy, EV, equity, and EQR) are provided for study and may contain errors; they are not financial, investment, gambling, or tax advice. Because the Service is an Alpha release, saved runs and other local data may be lost between updates; do not rely on the Service for important data.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the Service. Our total aggregate liability arising out of or relating to the Service shall not exceed the greatest of (i) the amount you paid us for the Service in the twelve (12) months preceding the claim, (ii) JPY 10,000, or (iii) USD 100.
The foregoing limitations do not exclude or limit our liability for (a) intentional misconduct or gross negligence, (b) death or personal injury caused by our negligence, or (c) any other liability that cannot be excluded or limited under applicable mandatory law, including the Japanese Consumer Contract Act. Where applicable law renders any limitation invalid, our liability is limited to the maximum extent permitted by law.
9. Changes & termination
We may modify these Terms or the Service. Where a modification is materially adverse to users, we will publish the modified Terms and the effective date on the website at least fourteen (14) days in advance. The advance-notice requirement does not apply where (a) the modification is solely beneficial to users, (b) the modification is required to address security, legal, regulatory, or abuse issues, or (c) immediate action is required during the Alpha. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. We may suspend or terminate access for violation of these Terms.
10. Notices
We may give notices to you by posting on the website, by in-app message, or by email to any address you have provided. You may give notices to us at support@rangeflux.com.
11. Order of precedence
In case of conflict between these Terms and the Privacy Policy, the Privacy Policy controls for matters of personal-data handling, and these Terms control for all other matters.
12. Language
These Terms are published in Japanese and English. If there is any conflict or inconsistency between the versions, the Japanese version prevails.
13. Severability & entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy referenced herein, constitute the entire agreement between you and us regarding the Service.
14. Pre-litigation consultation
Before commencing any litigation arising out of or relating to the Service, the parties shall first attempt to resolve the dispute through good-faith consultation for a reasonable period.
15. Governing law & jurisdiction
These Terms are governed by 日本法 / the laws of Japan. Disputes are subject to the exclusive jurisdiction of 東京地方裁判所 / Tokyo District Court.
